Purpose and legal grounds for processing of personal data

Vacuumservice processes personal data on the following grounds and for the following purposes:

Contract: Vacuumservice processes personal data submitted by the data subject in order to perform its part of the contract regarding the service as ordered by the data subject. Without the processing of such personal data Vacuumservice is not able to offer its services in accordance with the data subject’s request, process orders, provide logging in to customer’s account, authenticate customer’s actions, communicate with the customer on matters regarding the contract, offer technical support or invoice for its services.

Consent: Vacuumservice requests the data subject’s consent in order to process personal data obtained through cookies and similar technologies. Vacuumservice may also request the data subject’s consent in case the purposes for processing of personal data change. In addition, Vacuumservice may process other personal data related to the customer relationship with the data subject’s consent.

Legitimate interests: Vacuumservice processes personal data for developing its business and customer service, preventing and investigating abusive conduct, presenting and defending legal claims, analysing the usage of services, profiling, segmenting and targeting of contents, advertisement and marketing communications, and for targeted marketing via telephone or mail or based on the recipient’s working duties. These purposes are necessary for the business of Vacuumservice and justified based on the factual connection between the data subject and Vacuumservice and therefore in line with Vacuumservice’s legitimate interests. The data subject may object to the processing of personal data on grounds related to the data subject’s particular situation.

Legal obligation: Processing of personal data by Vacuumservice is based on the compliance with a legal obligation when Vacuumservice is obligated to retain any personal data of the data subject in order to comply with accounting or other mandatory legislation.

Personal data to be processed

Vacuumservice processes the following personal data of data subjects:

  • Basic information of an organisation, such as business name, business ID, postal address, visiting address, email address and phone number;
  • Basic information of an organisation’s representative and/or a contact person, such as name, title or occupation, address, email address and phone number;
  • Information based on the contractual relationship, customer relationship or other factual connection, such as communication language, customer ID, ordered services, delivery dates, other information related to the delivery of services, information on reclamations, seller information related to a contract, identification information related to the use of services, and information related to the use of services or offered benefits;
  • Information related to invoicing, payments and debt collection;
  • Information on whether the data subject has opted in or out of direct marketing;
  • Information on communication methods preferred by the data subject and changes to such preferences;
  • IP address, device information and cookie information of a user visiting the website;
  • Information related to logging in to web service; event and user analysis information;
  • Other information as submitted or otherwise given by the data subject;
  • Targeted information based on information collected from the trade register and other registers; and
  • Any other information with the consent of the data subject.

Data sources

Personal data is regularly collected in connection with entering into contracts, when data subjects become users of the service offered by Vacuumservice, in connection with the use of services, or otherwise from the data subject. Personal data may be collected and updated from generally available sources of information, such as companies’ websites, trade register, credit information register and other public or private registers. In addition, personal data may be obtained through the use of cookies or similar technologies.

Disclosure of personal data and transfers outside of the EU/EEA

Vacuumservice may disclose personal data in accordance with the applicable legislation. Personal data may be disclosed to Vacuumservice’s partners in order for Vacuumservice to provide the offered services.

Vacuumservice may use personal data of organisations’ representatives for direct marketing purposes jointly with its business partners, provided that the data subject has not explicitly objected to the use of their personal data for such purposes.

Vacuumservice uses subcontractors in the processing of personal data. Personal data is stored to servers managed and protected by IT service providers. Vacuumservice has ensured the appropriate protection of personal data by entering into appropriate data processing agreements with its subcontractors.

Vacuumservice does not generally transfer personal data included in its registers outside of EU/EEA. However, the service providers Vacuumservice uses for its support services (such as financial administration and email services) may transfer personal data to IT environments outside of EU/EEA. In such case, Vacuumservice and its service providers shall always ensure that personal data to be transferred will be appropriately protected in accordance with the applicable data protection legislation.

Protection and storage of personal data

Personal data is stored in databases protected by firewalls, passwords and other technical measures. Databases (including backup copies thereof) are located in locked and guarded facilities, which are appropriately protected and which can only be accessed by named and authorized persons.

Any system containing personal data may only be accessed by employees authorized to process customer data in accordance with their work assignments. Each user has his/her own username and password to the system. All employees processing personal data are bound by a confidentiality obligation.

Vacuumservice retains personal data for as long as necessary in order to process the information. Personal data will be deleted once all measures, obligations and liabilities regarding such data have expired and any claim period related to a customer or service relationship has expired. Typically data is retained for 6–10 years.

The need to retain personal data is regularly assessed considering the applicable legislation. In addition, Vacuumservice sees to that all reasonable measures are taken in order to ensure that, with respect to processing of personal data, no incompatible, outdated or inaccurate personal data of data subjects is retained in the registers. Such personal data will be corrected or deleted without undue delay.

Rights of data subject

The data subject has the right to review his/her personal data stored in the register and the right to obtain rectification or erasure of inaccurate, outdated, unnecessary or unlawfully processed personal data in accordance with the data protection legislation. The data subject has also the right to withdraw his/her consent in case Vacuumservice processes personal data based on consent given by the data subject. However, such withdrawal shall not apply to the lawfulness of processing of personal data taking place prior to the withdrawal of the consent.

The data subject has the right to object processing of personal data, request restriction of processing of personal data, as well as the right to lodge a complaint with supervisory authority. In case processing of personal data is based on the legitimate interests of Vacuumservice, the data subject has the right to object profiling and other processing of personal data on grounds related to the particular situation of the data subject. For such requests, the data subject must, in connection with the request, specify such particular situation based on which the data subject objects the processing of personal data.

All requests related to the rights of data subject must be in writing and sent to the above-mentioned contact person of Vacuumservice. 

Updates to privacy statement and cookie policy

Vacuumservice reserves the right to amend this privacy statement and cookie policy. Updated versions of the privacy statement and cookie policy are published in Vacuumservice’s website. In case of material amendments, Vacuumservice may notify the data subjects of such material amendments via other channels, for example by sending an email or by setting up a notice on its website. Vacuumservice recommends that data subjects visit Vacuumservice’s website regularly to familiarize themselves with the latest version of Vacuumservice’s privacy statement and cookie policy.
